Mr Jakkhu is bringing his second appeal against the judgment of Employment Judge King dismissing his claim for disability discrimination. The Employment Appeal Tribunal has allowed his appeal to proceed. The hearing date is awaited. This case concerns how an employment tribunal is to infer discrimination from a witness who does not attend the hearing and does not give evidence. The employer allowed his dismissal to occur on 24th September 2014, notwithstanding the agreement with the trade union not to make compulsory redundancies.
